0. Scope and Definitions
This policy governs cancellations, refunds, and (where applicable) the statutory right of withdrawal for purchases made through the Club LA BOOM website (the "Site") from Jasmin Rimmele, trading as Club LA BOOM ("we", "us", "CLB").
It applies to consumers within the meaning of Section 13 of the German Civil Code (BGB) - i.e., natural persons who purchase for purposes outside their trade, business, or profession. Business/B2B purchasers do not have a statutory right of withdrawal, regardless of product type; Section 2 does not apply to them.
Two product categories are addressed separately, because German law treats them differently:
Section 1 — Event Tickets: single-date/period leisure events (e.g., Tennis, Pickleball, Rooftop Sundowner).Section 2 — Memberships & Subscriptions: recurring or open-ended access products (not yet offered; reserved for future use).
1. Event Tickets (Fixed-Date Events)
1.1 No Statutory Right of Withdrawal
Club LA BOOM organizes leisure and social events (including, but not limited to, Tennis, Pickleball, and Rooftop Sundowner events) that take place on a specific, pre-announced date or within a specific time period.
Under Section 312g (2) No. 9 of the German Civil Code (BGB), consumers do not have a statutory right of withdrawal for contracts relating to the provision of services in the field of leisure activities where the contract provides for a specific date or period of performance.
Because every Club LA BOOM event ticket is tied to a fixed date and time, purchases of event tickets are excluded from the statutory 14-day right of withdrawal. By purchasing a ticket, you acknowledge and agree to this exclusion.
1.2 Our Voluntary Cancellation Policy
Since no statutory withdrawal right applies, the following contractual terms govern instead:
All ticket sales are final. We do not offer refunds, credits, or rebooking to a different event once a ticket has been purchased.Exception — Event cancelled or significantly rescheduled by Club LA BOOM: If we cancel an event, or reschedule it to a materially different date/time, you are entitled to a full refund of the ticket price, or, at your option, transfer of your ticket to a future event of equivalent value.Transfer to another person: If you are personally unable to attend, you may transfer your ticket to another person free of charge by notifying us in advance at jasmin@clublaboom.eu, subject to venue capacity and check-in requirements.
This section does not limit any statutory rights you may have that cannot be excluded by agreement (e.g., in cases of illegality, fraud, or gross misrepresentation).
1.3 Force Majeure
If an event is cancelled due to circumstances beyond our reasonable control (including but not limited to extreme weather, venue unavailability not caused by us, official/governmental order, or similar force majeure events), we will offer affected ticket holders either a refund or transfer to a future event, at our discretion, within a reasonable time.
1.4 Limitation of Liability
Except in cases of intent, gross negligence, or injury to life, body, or health, our liability for damages arising from a cancelled or rescheduled event is limited to the ticket price paid. This limitation does not affect any mandatory statutory liability that cannot be excluded under German law.
2. Memberships & Subscriptions (Future Offering)
Club LA BOOM does not currently offer memberships or subscription products. This section will govern such products once introduced, and will be updated with specific terms (minimum term, renewal, and cancellation notice periods) at that time.
2.1 Statutory Right of Withdrawal
Unlike single-date event tickets, membership and subscription contracts are not tied to one specific date of performance. Accordingly, the exemption in Section 1.1 above does not apply, and consumers are entitled to the standard statutory right of withdrawal under Sections 355 and 356 BGB, as set out below.
Right of Withdrawal
You have the right to withdraw from a membership/subscription contract within 14 days without giving any reason.
The withdrawal period will expire 14 days from the day of the conclusion of the contract.
To exercise the right of withdrawal, you must inform us -

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of Withdrawal
If you withdraw from the contract, we will reimburse all payments received from you without undue delay, and in any event not later than 14 days from the day on which we are informed of your decision to withdraw. We will use the same means of payment as you used for the initial transaction, unless expressly agreed otherwise; in any event, you will not incur any fees as a result of the reimbursement.
If performance has already begun at your request: If you requested that the membership begin (i.e., that we start providing member benefits) before the end of the withdrawal period, you shall pay us an amount which is in proportion to what has been provided until the point in time at which you inform us of your withdrawal, compared with the full coverage of the contract.

3. Data Protection
Information you provide in connection with a cancellation or withdrawal request (e.g., name, order details) will be processed solely to handle that request, in accordance with our Privacy Policy [LINK TO PRIVACY POLICY] and the EU General Data Protection Regulation (GDPR).
4. Governing Law and Jurisdiction
This policy and all purchases made through the Site are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). This does not deprive you, as a consumer, of any mandatory protections afforded by the law of the country in which you are habitually resident.
The EU's Online Dispute Resolution platform is available at https://ec.europa.eu/consumers/odr. We are not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board.
5. Severability
If any provision of this policy is or becomes invalid or unenforceable, the remaining provisions shall remain in full effect. The invalid provision shall be replaced by a valid one that most closely reflects its economic intent.
